FIRE SAFETY COMPLIANCE FOR SMALL BUSINESS IN QUEENSLAND

AS A SMALL BUSINESS, ARE YOU AWARE OF YOUR COMPLIANCE OBLIGATIONS UNDER THE QLD BUILDING FIRE SAFETY REGULATIONS 2008? (QBFSR 2008)

INTRODUCTION

Whether you are a small business or a multi national company, there is legislation that must be adhered to. Small business often do not realise that they have obligations under the QBFSR 2008 which must be fulfilled in order to be compliant. If the Fire Service comes into your business to conduct an inspection, and compliance is not being met under the QBFSR 2008, then large fines may apply. (up to 30 penalty units or $3697.00) for each non-compliance. The penalty unit value in Queensland is $121.90 (current from 1 July 2016).

HIGH OR LOW OCCUPANCY BUSINESS/BUILDINGS

First of all we need to understand the difference between a small and large business/building. Under the QBFSR 2008, business is determined by the amount of employees engaged by an employer or the height of a residential building and referred to as low and high occupancy buildings/business.

HIGH OCCUPANCY

A high occupancy building/business means a residential building exceeding 25 metres in height, (8 levels) or a business with over 30 employees. These buildings/businesses require additional compliance to smaller buildings/businesses.

LOW OCCUPANCY

A low occupancy building/business therefore, is a residential building less than 25 metres in height or a business with less than 30 employees. Whether you are a small business employing 2 employees or a larger small business employing up to 29 employees, there are still compliance obligations which must be met under the QBFSR 2008.

WHAT DOES A LOW OCCUPANCY BUILDING/BUSINESS REQUIRE?

QBFSR 2008, the following is required for all small businesses to meet compliance:

• FIRE AND EVACUATION WRITTEN PLAN. QBFSR 2008 (Division 2) Describes the general requirements for inclusion to managing entities, and secondary occupiers. It also demonstrates the relevant approval documents to be kept with the fire and evacuation plan and other matters relating to keeping, changing and reviewing the plan. The Fire and Evacuation Plan should also be developed in consideration of the requirements of AS3745 2010 ‘Planning for Emergencies in Facilities’ Maximum penalty 30 penalty units.

 

• EVACUATION SIGNS AND DIAGRAMS. QBFSR 2008 (Division 3) If the total area of your small business is over 300 square metres, then development and installation of these diagrams are a requirement. They must be displayed and appropriately located on each evacuation route of the building/tenancy. If your small business is less than 300 square metres in size, then it is not a requirement to develop and place these diagrams in your tenancy. Evacuation Signs and Diagrams should also be developed in consideration of the requirements of AS3745 2010 ‘Planning for Emergencies in Facilities’ Maximum penalty 30 penalty units.

 

• GENERAL AND FIRST RESPONSE EVACUATION INSTRUCTIONS.
QBFSR 2008 (Division 6) All staff employed by a small business must be trained in General and First Response evacuation procedures. A low occupancy tenancy does not require an Registered Training Organisation or Fire Safety Adviser to give these instructions, however, it would be highly recommended that the initial training be conducted by a qualified fire safety trainer to ensure appropriate understanding and appropriate procedures implemented. The tenancy responsible person can then conduct the yearly required training to employees to ensure compliance is met and maintained. It is also a requirement to retain records showing that the training has been given. General and First Response training should also be delivered in consideration of the requirements of AS3745 2010 ‘Planning for Emergencies in Facilities’ Maximum penalty 30 penalty units for each unit of instruction.

 

• EVACUATION COORDINATION INSTRUCTIONS (Warden Training)
QBFSR 2008 (Subdivision 5) If the tenancy is part of a multi-tenancy building, it would be normal for the managing entity for the building to supply this training for all tenancies within the building. If a low occupancy business is a stand alone building, the Evacuation Coordinator must give the evacuation coordination instructions to the persons responsible for carrying out the evacuation procedures, but only if the evacuation coordinator for the tenancy can competently carry out the procedures. Again, it would be highly recommended that the initial training be conducted by a qualified fire safety trainer to ensure understanding and appropriate procedures implemented. The tenancy responsible person can then conduct the yearly required training to employees to ensure compliance is met and maintained. It is also a requirement to retain records showing that the training has been given. Evacuation Coordination Instructions should also be delivered in consideration of the requirements of AS3745 2010 ‘Planning for Emergencies in Facilities’ Maximum penalty 30 penalty units.

 

• EVACUATION PRACTICE. QBFSR 2008 (Division 7) It is a requirement for all occupants of a building to complete an evacuation exercise every 12 months. If the tenancy is part of a multi-tenancy building, it would be normal for the managing entity for the building to supply this exercise for all tenancies within the building. If a low occupancy business is a stand alone building, the exercise is the responsibility of the occupier of the building. A debrief and report must be completed after the exercise to highlight areas that can be improved upon and any other recommendations that may be required. Evacuation Practice should also be completed in consideration of the requirements of AS3745 2010 ‘Planning for Emergencies in Facilities’ Maximum penalty 30 penalty units.

 

• RECORD KEEPING. QBFSR 2008 (Division 8) It is a requirement for small businesses to retain all records relating to fire training, evacuation exercises and maintenance of installed fire equipment that they are responsible for. If the Fire Service completes an inspection of your business, they will expect you to be able to supply these records. Maximum penalty 20 penalty units.
